Lake Views - Right of Prospect

Michigan law does not recognize lake views as a property right...

One morning, you awake to find a new house, shed, or fence being erected in the path of your view to the lake.

Unfortunately, unlike other states, Michigan does not recognize "prospect rights," i.e. the right to keep preexisting views to the water. Some states have limits on the erection or installation of buildings which obstruct the view of neighbors on a lake; Michigan isn't one of them.

That does not mean all is lost. Often times, enforcement of setback and height requirements under local zoning regulations can protect the views of the lake, indirectly.
